Qu’est-ce que la conciliation ?<\/u><\/strong><\/p>\n\n\n\n

La conciliation consiste dans l’intervention d’un tiers, le conciliateur de justice, qui, apr\u00e8s avoir \u00e9cout\u00e9 les parties et analys\u00e9 leur point de vue, leur propose une solution pour r\u00e9gler leur diff\u00e9rend. C’est le dernier recours pour tenter d’obtenir le r\u00e8glement amiable d’un litige avant d’engager une proc\u00e9dure judiciaire. Elle vise \u00e0 rechercher un compromis entre deux adversaires qui ont int\u00e9r\u00eat \u00e0 se concilier. C’est une d\u00e9marche non obligatoire qui, pour aboutir, suppose un minimum de bonne volont\u00e9 des parties.<\/p>\n\n\n\n

Qu’est-ce qu’un conciliateur de justice?<\/u><\/strong> <\/p>\n\n\n\n

Il est charg\u00e9, en dehors de tout proc\u00e8s, d’aider les citoyens \u00e0 r\u00e9gler des litiges et peut \u00eatre saisi, sans formalit\u00e9 particuli\u00e8re, par tout consommateur, au cours de permanences.
La t\u00e2che du conciliateur est de mettre les parties au litige en pr\u00e9sence et de les amener \u00e0 d\u00e9couvrir eux-m\u00eames la solution \u00e0 leur diff\u00e9rend. L’accord des parties, s’il est obtenu, pourra \u00eatre concr\u00e9tis\u00e9 par un constat d’accord (obligatoire lorsqu’une des parties renonce \u00e0 un droit) qui aura la valeur juridique d’un contrat. Le juge d’instance peut donner force ex\u00e9cutoire \u00e0 ce constat d’accord si l’une des parties le demande.<\/p>\n\n\n\n
